Terms & Conditions of Sale and Website Use

These Terms & Conditions apply to your use of the Finerfilters website and to any order placed with Finerfilters Limited for goods sold through the website. By using our website or placing an order, you agree to these Terms & Conditions.

2. Definitions

In these Terms:

  • “we”, “us” and “our” mean Finerfilters Limited;
  • “you” and “your” mean the customer placing an order or using the website;
  • “goods” means the products we sell through our website; and
  • “contract” means the contract formed between you and us when we accept your order.

3. Use of this website

You may use this website only for lawful purposes.

You must not:

  • misuse the website;
  • attempt to gain unauthorised access to the website, its systems or connected services;
  • introduce malicious code, viruses or other harmful material;
  • interfere with the website’s operation or security; or
  • copy, scrape, reproduce, distribute or commercially exploit website content without our prior written permission.

4. Product information

We take reasonable care to ensure that product descriptions, specifications, images, prices and availability information are accurate.

However:

  • product images are for illustrative purposes;
  • product colours and appearance may vary depending on your device or screen;
  • packaging may vary from the images shown;
  • manufacturers may update products or packaging; and
  • there may occasionally be minor differences between website content and the goods supplied.

If we discover a material error in product information or pricing before despatch, we will contact you before proceeding with the order.

5. Placing an order

When you place an order, you will receive an order acknowledgement confirming that we have received it.

The order acknowledgement does not constitute acceptance of your order.

A contract is formed only when we accept your order and despatch the goods.

We reserve the right to refuse or cancel an order before despatch where:

  • there is a pricing or product-information error;
  • a product is unavailable;
  • payment cannot be authorised or verified;
  • delivery is not available to the address provided;
  • we reasonably suspect fraud or misuse; or
  • we are otherwise unable to fulfil the order.

If we cancel an order after payment has been taken, we will arrange an appropriate refund.

6. Price and payment

All prices shown on the website are in GBP (£) unless otherwise stated.

The price payable will be the price shown at checkout when you place your order, together with any applicable delivery charges shown before payment is completed.

Payment must be authorised or successfully received before goods are despatched.

We use secure third-party payment providers and do not store full payment card details on our own systems.

7. Delivery

Delivery options, charges and estimated delivery times are shown on the website, at checkout or in our Delivery Policy.

We offer free standard delivery to mainland UK for orders over £30, unless otherwise stated at checkout.

Same-day despatch is normally available for qualifying orders placed before 14:00 on weekdays, excluding UK public holidays. Same-day despatch is not guaranteed.

Most standard mainland UK orders are estimated to arrive within 2 to 3 working days from despatch, although delays may occur.

Unless a different timeframe is agreed with you, goods should be delivered within 30 days of the contract being formed.

Risk in the goods passes to you when the goods are delivered to the delivery address you provided, a person identified by you to receive them, or an alternative delivery location authorised by you.

8. International orders

We may accept orders for delivery outside the UK.

International customers may be required to pay:

  • import duty;
  • local taxes or VAT;
  • customs charges;
  • courier administration or handling fees; or
  • similar charges imposed in the destination country.

These charges are not controlled by Finerfilters and remain the responsibility of the customer unless expressly stated otherwise at checkout.

International orders may also be affected by customs inspections, local delivery restrictions and delays outside our reasonable control.

9. Consumer cancellation rights

If you are a consumer buying online, by phone or by mail order, you will usually have the right to cancel your order within 14 days of receiving the goods without giving a reason.

If your order is delivered in multiple parts, the cancellation period will usually begin when you receive the final item.

If you exercise this right, you must return the goods within 14 days of telling us that you wish to cancel.

We will refund eligible payments, including the cost of standard delivery where applicable, within 14 days of receiving the returned goods.

If you selected a more expensive delivery option, we will not be required to refund more than the cost of our standard delivery service.

Nothing in these Terms affects your statutory rights.

10. Cancellation exclusions

The right to cancel does not apply in every case.

It may not apply to:

  • personalised or custom-made goods;
  • perishable goods;
  • sealed goods that cannot be returned for health or hygiene reasons once opened; or
  • other goods excluded from cancellation rights under applicable law.

Because many of our products are water filtration consumables, we may refuse change-of-mind returns of items that:

  • have been installed;
  • have been used;
  • have been altered;
  • have been brought into contact with water; or
  • are no longer in a resaleable condition.

This does not affect your rights where goods are faulty, damaged, not as described, incorrectly supplied or otherwise returnable under applicable law.

11. Faulty, damaged or incorrect goods

If goods are faulty, damaged, not as described, incorrectly supplied or do not do what they are supposed to do, you may be entitled to an appropriate remedy.

Depending on the circumstances, this may include:

  • repair;
  • replacement;
  • refund; or
  • another remedy available under applicable consumer law.

We may ask you to provide:

  • your order number or proof of purchase;
  • a description of the issue;
  • photographs or videos;
  • details of how the product was installed, used or maintained; or
  • the goods for inspection and testing.

We must be given a reasonable opportunity to investigate the reported issue and determine the appropriate remedy.

12. Installation and third-party costs

Finerfilters does not provide installation services unless installation has been expressly agreed in writing as part of your order.

If you independently appoint a plumber, installer or other contractor, that person is engaged directly by you and does not act on behalf of Finerfilters.

You are responsible for:

  • selecting a suitably qualified and competent installer;
  • checking that the product is suitable before installation;
  • providing the installer with the supplied instructions;
  • agreeing the scope and cost of the work directly with the installer; and
  • allowing Finerfilters a reasonable opportunity to investigate any reported product issue before paid remedial work is arranged.

If you believe a product is faulty, damaged, incorrect or unsuitable, please contact Finerfilters before arranging paid inspection, repair, alteration, removal or reinstallation work.

We will not normally reimburse costs incurred without our prior written approval, including:

  • plumber or installer call-out charges;
  • diagnostic or inspection fees;
  • installation charges;
  • removal or disconnection costs;
  • reinstallation costs;
  • remedial-work charges;
  • third-party labour charges;
  • replacement parts sourced independently; or
  • transport arranged independently by the customer.

Where we agree in advance to contribute towards a third-party cost, the amount and scope of that contribution must be confirmed by Finerfilters in writing before the work begins.

Nothing in this section excludes or limits your statutory rights. Where goods are confirmed to be faulty and applicable consumer law requires Finerfilters to meet reasonable and necessary costs associated with providing a repair or replacement, we will do so in accordance with those legal obligations.

13. Warranty

Some products are supplied with:

  • a manufacturer’s warranty;
  • a Finerfilters-backed warranty period; or
  • product-specific warranty terms shown on the product page, packaging, instruction manual or accompanying documentation.

Unless expressly stated otherwise, warranty cover does not apply to:

  • misuse or abuse;
  • use outside the product’s intended purpose;
  • incorrect, unsafe or improper installation;
  • freezing damage;
  • hot-water damage;
  • unsuitable or excessive water pressure;
  • accidental damage;
  • lack of maintenance;
  • unauthorised repair or modification; or
  • normal wear and tear.

Consumables such as filter cartridges, membranes, resin and replacement media are service-life items and are not covered for normal depletion through use.

This does not affect your statutory rights where a product is faulty, damaged, not as described or otherwise does not conform to the contract.

14. Promotional codes and discounts

Promotional codes and discount offers remain subject to their own terms and conditions.

Promotional codes may:

  • be restricted to eligible customers, products or orders;
  • have an expiry date;
  • require a minimum order value;
  • be limited to one use per customer or order;
  • be unavailable with other offers; or
  • be withdrawn or amended where permitted.

We may refuse, remove or reverse a promotional benefit where a code has been used incorrectly, fraudulently, outside its stated terms, or by someone who was not eligible to use it.

15. Subscriptions

Where a product is offered on a recurring subscription, Subscribe & Save or similar basis, additional terms will apply.

By placing a subscription order, you authorise recurring payments in accordance with the delivery frequency, billing schedule and subscription option selected at checkout.

16. Intellectual property

All content on this website, including:

  • text;
  • images;
  • product descriptions;
  • graphics;
  • branding;
  • logos;
  • videos;
  • software; and
  • the selection and arrangement of website content,

is owned by or licensed to Finerfilters Limited.

You may not copy, reproduce, publish, distribute, adapt, modify, scrape or commercially exploit any website content without our prior written permission, except where permitted by law.

17. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot legally be excluded or limited.

Subject to the above, we shall not be liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

We are not responsible for loss or damage resulting from:

  • misuse of a product;
  • incorrect installation;
  • failure to follow product instructions;
  • unauthorised repairs or modifications;
  • use outside the product’s intended purpose; or
  • the acts or omissions of an independently appointed plumber, installer or contractor.

This section does not affect any rights or remedies available to consumers under applicable law.

18. Events outside our reasonable control

We are not responsible for a failure or delay in performing our obligations where that failure or delay is caused by an event outside our reasonable control.

Such events may include:

  • severe weather;
  • fire or flood;
  • industrial action;
  • courier or transport disruption;
  • customs delays;
  • supplier failure;
  • interruption to utilities, internet services or payment systems;
  • government action or legal restrictions; or
  • other circumstances that could not reasonably have been prevented.

If such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

19. Privacy, cookies and marketing

We process personal information in accordance with our Privacy Policy.

We use cookies and similar technologies in accordance with our Cookie Policy.

Non-essential cookies and similar technologies may require user consent unless an applicable exemption applies.

We may send marketing communications where:

  • you have given consent; or
  • we are otherwise permitted to do so under applicable law, including the limited soft opt-in rule for existing customers receiving information about our own similar products or services.

You can opt out of marketing communications at any time using the unsubscribe option provided or by contacting us.

20. Changes to these Terms

We may update these Terms from time to time.

The version published on the website at the time your order is placed will apply to that order.

Any updated version will display the relevant revision date at the top of the page.

21. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as removed only to the extent necessary.

The remaining provisions will continue to apply.

22. Governing law

These Terms and any dispute or claim arising from them shall be governed by the laws of England and Wales.

The courts of England and Wales shall have jurisdiction, except where mandatory consumer law permits you to bring proceedings in another jurisdiction.
